SWIMKIDS
USA POLICIES AND PROCEDURES
1a.
Agreement:
This legally binding agreement represents
the complete understanding between SwimKids USA and the customer. No representations,
written, or oral, other than those contained within this agreement are authorized or binding with SwimKids
USA.
1b.
E-Mail:
SwimKids USA major source of communication to you and your family is via e-mail.All customers must keep an active e-mail address, (one that you check daily), on file with SwimKids USA at all times, and notify us
of any changes immediately by sending an e-mail to swimkidsusa@aol.com.
2. Tuition:
All tuition and registration fees must be paid at the time of enrollment for
all classes. The annual registration fee is nonrefundable. As a Customer Incentive,
if the Annual Registration Fee is paid in advance prior to the start of the new
Calendar Year, the following discounted Registration Fee will apply:
December 1st thru December 15th: $30
December 15th thru December 31st: $35
January 1st and After: $40
3. Due
Date:
If you register via phone and prefer to pay by check,
you must secure your
reservation with a bank or credit card. Your card will not be charged as long
as we receive
your payment and signed registration form prior to the due date. If your payment
is not received
by the due date, you authorize us to charge your balance due with your credit
card. If your
reservation is not secured, and payment is not received by the due date, your
reservation
will be cancelled. If your payment is received after cancellation, we will reserve
your child
in the next available class and send you out a confirmation notice with the
new schedule.
4. Returned
Check Policy:
If a check is returned for any reason, a $ 25.00
fee will be charged
to your account. You authorize us to charge your credit card if your credit
card is on file. If there
is no credit card on file, both the returned check fee and balance due must
be paid within 24 hours
upon our notification to you via credit card or your reservation will be cancelled.
5. Automatic
Payment Request:
As an added convenience, you authorize SwimKids
USA to
maintain your credit or bankcard information for future enrollments and payments
on your
account. SwimKids USA will not release or sell this information to any company
or organization
6. Rescheduling
Fee:
You have a reserved class
time. Make sure you have made a reservation in a class
that fits your schedule. SwimKids USA is not responsible for reminding you of
your schedule.
If you wish to reschedule your child into another class for any reason other
than the one he/she
is registered for, you must do so by completing the Rescheduling Form under the Schedule Section on our website,
and the appropriate administrative fee per child will apply:
Greater than 10 days prior to the start of class: $10.00
Between 4 and 10 days prior to the day of class: $25.00
Within 3 days prior to the start of class: $50.00
The day of or after your childs class has started: $75.00
These fees are used to offset the potential and realized lost income by turning
away business
that you once reserved for your child. You authorize SwimKids USA to charge
your credit card
on file, or if no credit card is on file, an invoice will be sent and must be
paid by the invoice
due date.

Class Length The above policies
will be enforced without exception. I understand that SwimKids USA
reserves
the right to change its policies and rates at any time. All updates to Policy
and
Procedures can be found on the SwimKids USA Website. By enrolling in SwimKids
USA's
program, I agree that I am doing so at my own risk. SwimKids USA shall not be
held liable
for damages arising from personal injury sustained by myself, family, or guests
while on the
premises of the contracted pools. I assume full responsibility for any injuries
that may occur,
and I release and discharge SwimKids USA, its owners, employees, contracted
pools, and
agents from all claims resulting from my use of the facilities and participation
in the program(s).
I represent that the participant(s) I am enrolling is in good physical condition,
and has no
disability or impairment that would be detrimental to the health, safety, or
physical condition
of their being by participating in the program.
It is your responsibility to enroll your child in the proper class level. There is a Question and Answer Session available
on the Course Description Page of our website to assist you in determining thier proper skill level, as well as the Course Descriptions themselves. Additionally,
SwimKids USA can assist you over the phone or via e-mail as well. It is you responsibility to notify us if your child needs to be moved into a different level other than the one you reigstered them for prior to class. Failure to do so will result in
your child being placed in the incorrect level, and our Rescheduling Fee Policy and Fees will apply .
You understand that due to the nature of the business, SwimKids USA consolidates its classes the day before class to eliminate any gaps that may exist in the instructors
schedule. By doing so, may reflect a change in your childs class time. You agree that you will log on to the
SwimKids USA website, the DAY OF CLASS, to verify the time of your childs class.
SwimKids USA teaches at several pools in your area. While consolidating classes, there may be an instance where a duplicate class is offered at another pool in close proximity
that is underbooked.
In those cases, you understand that you may be transferred to attend classes at that pool, rather than the one initially registered for.
As long as the other location is within a 5 mile radius, and the time change is not greater than 1 hour either way, you understand the business reasons for doing this,
and agree to do so.
SwimKids USA will notify you via e-mail or mail prior to the start of class.
If, for any reason you wish to cancel and
request a
refund, you must do so by completing the Cancellation Form under the Schedule Section on our website. The following
cancellation fees per child will apply:
Greater than 7 days prior to the start of class: $25.00
Within 7 days prior to the day of class: $50.00
The day your child's class has started: There is no compensation.
The Annual Registration fee is nonrefundable
There are no Make-Ups for missed classes at SwimKids USA. However, you may purchase Make-Up Lessons for missed
classes at a discounted rate ($5.00 each) by completing the make-up form on our website. Make up lessons may only be taken in a class
that is UNDERBOOKED and only DURING the month in which they were missed. Make up lessons will not be rescheduled
once booked. Limit 2 per child per month.
Regardless of weather conditions, you are required to check in with the instructor
for each class at your scheduled time. Please do not call SwimKids USA or the pool to
ask, as
they are not aware if we will or will not have class. If, after checking in,
inclement
weather or acts of God cause the cancellation of class, the following policies
will apply:
1-3 classes missed: Classes will be extended by: 5 minutes for the remaining classes. We will make every attempt
to make up all lost time, although you understand that it may be beyond our control depending on which class was cancelled
4-8 classes missed: We will reschedule your child into our next available 8-class
session.
The tuition is free, however, your account will be charged for the number of
classes attended in the previous session. Classes that have been in progress for more than 1/2
the time are not made up. Classes cancelled on the last day due to inclement are not made
up.
Some classes are held on holidays. If you have a question on if classes
are held
on a particular holiday, please view the dates that are on the Schedule Search Page prior to registering.
There are rare occasions when our contracted pools are closed for a variety of different reasons. Because SwimKids USA does not own
any of these pools, these occurences are beyond our control. Therefore, make up claases are not given for pool closures. However, our instructors will
do thier best to see to it that your child completes the required skills in the amount of classes attended.
There are no make-ups for illness.
You do however, have 3 options. First, you may do nothing, and hope that your child catches up to the material they missed.
Your instructor will do everything they can to get them caught up when they return.
Or, if you prefer, you may enroll in some
make up classes or reschedule.
If you wish to enroll in make ups or reschedule, simply complete the appropriate form on our
website. Our Make Up and/or Rescheduling Fees will apply.
In the event a class needs to be cancelled due to a teacher's illness, we will
make every
attempt to contact you prior to class. If 1-2 classes are cancelled, we will
make up the
time by adding :5-10 minutes to the rest of the remaining classes. If there
is an extended
illness, a no cost make up will be scheduled. There are no make-ups for missed make
up classes.
4-6 Children per Class: 35 minutes
3 Children per Class: 30 minutes
2 Children per Class: 20 minutes
1 Child per Class: 15 minutes
I understand that SwimKids USA forbids the solicitation of any of our instructors
for any swim
lessons, and reserves the right to expel any family without refund if found
doing so. Additionally, you authorize us to charge your credit card on file for the cost
of the lessons
that would have been assessed had you registered your child with SwimKids USA.
SwimKids
USA also reserves the right to expel any family that does not abide by the SwimKids
USA
philosophy, failure to follow any and all rules, or use inappropriate language,
or is disrespectful
to instructors, staff, or fellow classmates.
